These Terms & Conditions (“Terms”) govern the use of the King Of Trade & Serious Music website (the “Website”) and the purchase of products offered through the Website.
King Of Trade & Serious Music, hereinafter referred to as “KoT,” “we,” “us,” or “our,” is a subsidiary of SGR Industries Canada Ltd. By accessing the Website, creating an account, placing an order, or purchasing any product through the Website, you acknowledge that you have read, understood, and agree to be bound by these Terms, together with any other policies referenced herein.
1. Products and Product Condition
Unless otherwise expressly stated in an individual product listing, products offered for sale through the Website are secondhand, pre-owned, used, refurbished, or previously owned products.
Because many of the products sold by KoT are pre-owned or refurbished, individual items may exhibit signs of previous use, including but not limited to cosmetic wear, scratches, dents, marks, discoloration, or other imperfections consistent with their age and prior use. Where applicable, KoT will make reasonable efforts to disclose material defects, significant wear, missing components, or other relevant conditions in the product description.
Customers are responsible for carefully reviewing the product description, photographs, specifications, included accessories, and stated condition of an item before placing an order.
Unless specifically stated otherwise, photographs and descriptions are intended to accurately represent the product being offered but may not capture every minor cosmetic imperfection or variation.
2. Product Availability
KoT makes reasonable efforts to maintain accurate and current inventory information on the Website. However, many products offered by KoT are limited in quantity, unique, one-of-a-kind, or otherwise subject to availability.
As a result, an item may become unavailable due to a prior sale, inventory discrepancy, technical issue, administrative error, or other circumstance before KoT is able to update the Website.
Adding an item to a shopping cart, submitting an order, or receiving an automated order acknowledgment does not necessarily constitute confirmation that KoT can fulfill the order.
If KoT determines that a purchased product is unavailable or cannot reasonably be fulfilled, KoT will notify the customer as soon as reasonably practicable.
3. Order Acceptance and Cancellation
All orders submitted through the Website are subject to acceptance and availability.
KoT reserves the right, to the extent permitted by applicable law, to refuse, cancel, or limit any order for legitimate business reasons. Such circumstances may include, without limitation:
If KoT cancels an order after payment has been received, KoT will refund the amount paid for the affected product in accordance with the refund provisions outlined in these Terms.
4. Pricing and Listing Errors
KoT makes reasonable efforts to ensure that product prices, descriptions, photographs, specifications, and other information displayed on the Website are accurate.
However, errors may occasionally occur. If KoT discovers an error in the price, description, availability, or other material information associated with an order, KoT reserves the right, subject to applicable law, to contact the customer regarding the error and determine whether the order can reasonably be fulfilled.
If an order cannot be fulfilled because of an applicable error or other circumstance, KoT may cancel the affected portion of the order and issue a refund for any amount paid for the affected product.
5. Payment
Customers are responsible for providing accurate and complete billing and payment information when placing an order.
Orders are subject to successful payment authorization and processing. KoT is not responsible for delays, declined transactions, authorization failures, or other issues caused by a customer's payment provider or financial institution.
KoT reserves the right to delay or cancel an order where payment cannot be successfully verified or processed.
6. Refunds for Unfulfilled Orders
If KoT is unable to fulfill an order, or any portion of an order, for a reason attributable to product availability, inventory discrepancies, or another circumstance preventing fulfillment, KoT will issue a refund for the applicable amount paid.
Refunds for unfulfilled products will generally be initiated within three (3) business days after KoT confirms that the applicable product cannot be fulfilled.
The time required for the refunded funds to appear in the customer's account may vary depending on the customer's financial institution, payment method, or payment processor. KoT does not control processing times imposed by third-party financial institutions.
7. Returns and Exchanges
Unless otherwise expressly stated in a product listing or separate written agreement, all sales are subject to KoT's applicable return policy.
Because KoT primarily sells secondhand, pre-owned, used, refurbished, and unique products, certain items may be sold on a final-sale basis. Customers should review the applicable product listing and return terms before completing a purchase.
Where a return is permitted, the product may be required to be returned in the condition in which it was received, together with any accessories, packaging, documentation, or other items originally supplied with the product.
KoT reserves the right, to the extent permitted by applicable law, to refuse a return where the product has been damaged, altered, modified, misused, or otherwise materially changed after delivery.
Nothing in these Terms is intended to limit or exclude any rights or remedies that cannot legally be excluded or limited under applicable consumer-protection legislation.
8. Refurbished Products
Where a product is specifically identified as refurbished, the term refers to a previously owned or used product that has undergone some level of inspection, testing, repair, cleaning, restoration, or other preparation before being offered for resale.
The extent of refurbishment may vary from product to product. Customers should review the individual product listing for information regarding the condition, testing, repairs, included components, and any known issues associated with a refurbished product.
Unless expressly stated otherwise, a refurbished product should not be assumed to be equivalent to a brand-new product.
9. Product Descriptions and Specifications
KoT makes reasonable efforts to provide accurate product descriptions and specifications. However, minor discrepancies may occur, particularly with secondhand or refurbished products.
Product dimensions, colours, specifications, model information, photographs, accessories, packaging, and other details may vary where reasonably attributable to the individual item's condition, manufacturer variations, previous ownership, refurbishment, or other factors.
Customers are encouraged to contact KoT before purchasing if they require clarification regarding a product's condition, specifications, compatibility, included accessories, or other material characteristics.
10. Shipping and Delivery
KoT will make reasonable efforts to process and ship accepted orders within the timeframe communicated to the customer.
Estimated delivery dates and shipping times are provided for convenience and are not guaranteed unless expressly stated otherwise.
KoT is not responsible for delays caused by circumstances outside its reasonable control, including delays caused by shipping carriers, weather, transportation disruptions, customs procedures, incorrect or incomplete delivery information, or other third-party circumstances.
Customers are responsible for providing accurate shipping and contact information at the time of purchase.
11. Risk of Loss
Where applicable, responsibility for a product during shipment will be determined in accordance with applicable law and the shipping terms associated with the order.
Customers should inspect delivered packages and products as soon as reasonably possible after delivery and should promptly notify KoT of any apparent shipping damage or discrepancy.
12. Limitation of Liability
To the fullest extent permitted by applicable law, KoT, SGR Industries Canada Ltd., and their respective owners, officers, employees, agents, contractors, and representatives will not be liable for indirect, incidental, special, consequential, or other damages arising from the purchase, use, inability to use, or unavailability of a product or the Website.
Nothing in these Terms excludes or limits liability, rights, warranties, or remedies that cannot legally be excluded or limited under applicable law.
Where liability may legally be limited, KoT's liability will be limited to the maximum extent permitted by applicable law.
13. Website Availability
KoT makes reasonable efforts to maintain the availability and functionality of the Website. However, uninterrupted access cannot be guaranteed.
The Website may occasionally be unavailable due to maintenance, technical difficulties, updates, security issues, hosting problems, or circumstances outside KoT's reasonable control.
KoT does not guarantee that the Website will always be error-free, uninterrupted, secure, or free from technical defects.
14. Changes to Products, Prices, and Terms
KoT reserves the right to modify, discontinue, or update products, product listings, prices, services, Website features, and policies at any time, subject to applicable law.

17. Governing Law
These Terms are governed by the laws applicable in the jurisdiction in which KoT operates, without regard to conflict-of-law principles, except where applicable consumer-protection legislation provides otherwise.
Any dispute arising from or relating to these Terms or a purchase through the Website will be subject to the applicable laws and courts having jurisdiction over the matter.
18. Severability
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be interpreted or modified to the minimum extent necessary to make it enforceable where legally permitted.
The remaining provisions of these Terms will continue in full force and effect.
19. Entire Agreement
These Terms, together with any applicable product listing, return policy, privacy policy, shipping policy, and other policies expressly incorporated by reference, constitute the applicable agreement between the customer and KoT regarding purchases made through the Website, except where otherwise required by applicable law.
